Corporate Terms and ConditionsThe terms and conditions found within this document bind you (the client) to the hire of vehicle(s) and chauffeur(s) from us (Rainbow Chauffeur Drive Limited). Once you have read and agreed to the terms and conditions of hire as contained within this document, you are then legally bound by it.
All business between clients and Rainbow Chauffeur Drive Ltd is a transaction based on the terms and conditions defined. When any client places an order, the assumption, therefore, is that the client agrees to all the terms and conditions defined here.
Quotations
- Quotations are based upon costs prevailing at the time the quotation is given and in accordance with the details provided by the Hirer. Any subsequent additions, deletions or amendments will require a new quotation to be given.
- Unless otherwise stated such quotations will remain valid for a period not exceeding 28 days and are subject to availability at the time of quotation.
Booking
- Rainbow Chauffeur Drive reservation team will make every effort to assist their clients 24/7. We will strive to always exceed all expectations, but 24 hours’ notice may be required to prepare the chauffeured vehicle for your specific journey.
- To obtain a quote or make a booking through our booking team, you are required to provide us with full contact details, full name, contact number, and email address.
- All prices quoted are in GBP, with hiring starting at the pickup point (A) and finishing at the drop-off point (B) except those transfers which have been agreed to pick-up / drop off on route at the time the booking was accepted.
- A 25% deposit is required at the time a booking is confirmed. The balance of the cost of the trip must be paid prior to 28 days of date of first pick up. If the booking is received and confirmed within 28 days of first pick up, full payment must be made
- Bookings can be made by the client(s) via telephone, email or our website www.rainbowprestige.co.uk
- Bookings must be confirmed by the client(s) by email to julie@rainbowchauffeurdrive.co.uk within 24 hours of the booking.
- Bookings will be confirmed to the client(s) once an email confirming the details of the booking has been received.
- Bookings agreed with the client(s) are for a pre-defined period of time from base to base.
- If the booking(s) is cancelled by the customer once the hire has commenced, a 100% fee will apply.
- All return journeys on the same day are subject to waiting time charges if the return journey is within 4 hours or out of Aberdeen.
- Additional time is charged in 15-minute intervals.
- Unless otherwise stated quotations will not include the payment of tolls, ferry charges, parking fees, accommodation, admission charges, etc. where applicable.
- All prices are subject to VAT at the current UK rate of 20%.
- All quotes for journeys collecting from a flight into a UK airport include 15 minutes of complimentary waiting time. All other journeys include 15 minutes of complimentary waiting time. After the complimentary waiting time for all journeys, a charge calculated in 15-minute increments will be applied to the provided debit or credit card when the booking is been made. We reserve the right to charge to any credit or debit card provided at the time of booking.
- We reserve the right to switch vehicles before a run based on availability without prior notice, if a vehicle that was previously requested is unavailable or if there is a risk of a driver not making it on time for a pick-up.
- All online bookings are subject to Rainbow Chauffeur Drive approval. Occasionally errors may occur where online maps & quotes are calculated incorrectly, in the instance where an error is made and a product is listed at an incorrect price, Rainbow Chauffeur Drive shall maintain the right to refund or cancel orders placed at the incorrect price. If the order has been confirmed and charged to your credit card, Rainbow Chauffeur Drive shall immediately issue a credit in the amount of the incorrect price or where unsuitable issue a full refund.
- Rainbow Chauffeur Drive may provide sub-contracted vehicles. Every effort will be made by Rainbow Chauffeur Drive to ensure that our vehicle(s) or sub-contractors’ vehicle(s) arrive on time.
No-Show Policy
- If the customer fails to show up at the designated location and time for which a reservation has been made and a confirmation was sent out, all monies paid will be non-refundable
Payment
- All charges specified herein are payable in advance except for where the client has a credit account or a credit card pre-approved by Rainbow Chauffeur Drive. The credit or debit card you provide when making the booking will be charged for any additional charges e.g., extra waiting time, and parking charges.
- We accept all major debit and credit cards, including Amex at no extra charge. However, card charges are non-refundable for booking cancellations.
- All quoted prices are inclusive of 20% VAT.
- Your booking may be subject to additional waiting time and car park charges.
- The charge on your credit/debit card statement will be shown as Rainbow Chauffeur Drive.
- Rates are subject to change at any time without prior written notice.
- Hourly or daily hire costs are calculated base to base.
- Minimum charges apply to single trips only. Hourly hire has a 2-hour minimum hire, and daily hire is defined as 8 hours minimum hire per day.
- All bookings starting or finishing between 23:00 pm – 07:00 am are subject to 25% additional charge.
- Prices or bookings do not allow for public and bank holidays like Christmas Eve or Day, or New Year’s Eve or Day where 50% additional charges will apply. All other bank holidays will be subject to a 25% surcharge.
- When an account is closed, the customer shall pay us all outstanding charges which are owed to us as at the date of termination of their account.
Account Services
- Before making any booking for account services, the customer must open an Account with Rainbow Chauffeur Drive. Customer must keep its dedicated and secret customer account number in a safe and secure place.
- When making any booking for account services, the customer must quote their customer’s account name or number. Rainbow Chauffeur Drive shall not be obliged to use their account services should the account name or number not be submitted.
- Rainbow Chauffeur Drive shall be entitled to treat any booking made quoting the confidential customer account number as authorization by the customer and the customer shall be liable for all charges relating to the booking.
- In consideration of the performance of the account services, the customer shall pay all Charges, the administration fee, and any applicable VAT (without set-off or deduction), as invoiced by Rainbow Chauffeur Drive, within 30 days (or a shorter period as we in our absolute discretion notify you) of the date of an invoice (the “Due Date”).
- Payment shall be made by bank transfer (BACS) to such bank account as we shall notify the customer.
- Up to 30% administration fee may apply to your booking(s) or cancellation based on administration time and efforts spend by our admin team. Such cost will be at the company’s discretion.
- We shall invoice the customer each month in respect of the account services carried out for the Customer during the previous month or at such other intervals as may be agreed by the parties in writing.
- In the event of non-payment of any charges by the due date, we shall be entitled to charge and the customer shall pay interest at a rate of 10% per annum on any amount outstanding until payment is made, both before and after any judgment.
- We may, at any time, set a credit limit for any customer at any one time and we shall not provide account services once that limit has been reached. Any such limit shall be notified to the Customer in writing by us.
- Any dispute in respect of the charges shall be submitted, in writing, within 14 days of receipt by the customer.
- When an account is closed, the customer shall pay us all outstanding charges which are owed to us as at the date of termination of their account.
Cancellation and Refund Policy
- For all bookings (excluding wedding-related bookings) cancellations or amendments must be made and acknowledged by Rainbow Chauffeur Drive during office hours
- Cancellation within 24 hours of booked journey – 100% of hire charge.
- Cancellation between 7 and 2 days before journey – 50% of hire charge.
- In the event of a booking being cancelled by the client(s) all cancellations must be notified by email or telephone. In the event of a booking being cancelled by Rainbow Chauffeur Drive Limited then a full refund of any monies paid at the date of cancellation will be refunded to the client(s) by bank transfer, credit/debit card or company cheque within 30 days.
- For bookings involving two or more vehicles in one day or one vehicle for multi-day hire or two or more bookings on different days, the following cancellation or amendments fees will apply:
- For all wedding-related bookings 14 days, notice must be provided to cancel wedding bookings.
- If wedding cancellations are made within 14 days 50% of the booking fee will be charged. If wedding cancellations are made less than 48 hours of the booking date the full amount will be charged.
- If the cancellation is made and acknowledged by our office team, during office hours, Rainbow Chauffeur Drive will refund any charge to the debit or credit card used to make the booking. Please note debit or credit card charges are not refundable.
Terms and Conditions
- Whilst Rainbow Chauffeur Drive Limited will do our utmost to ensure our chauffeur(s) are punctual, you will understand that we cannot accept responsibility for delays caused by circumstances out with our control.
- Rainbow Chauffeur Drive Limited suggests for all airport departures that the client(s) allows a minimum of ninety minutes prior to any flight departure time. Rainbow Chauffeur Drive Limited accepts no responsibility for any missed flights, however caused.
- Rainbow Chauffeur Drive Limited suggests for all train departures that the client(s) allows a minimum of thirty minutes prior to any train departure time. Rainbow Chauffeur Drive Limited accepts no responsibility for any missed trains/flights, however caused.
- All meet and greet bookings with Rainbow Chauffeur Drive Limited will guarantee the client(s) being met by uniformed chauffeur(s) with name board.
- Rainbow Chauffeur Drive Limited will abide with all traffic and parking laws and will not and should not be instructed to break any laws to suit your needs.
- Any parking contraventions or parking penalty charges incurred through the direct intervention and order of the client(s) will result in the client(s) being liable for any resulting charges.
- Rainbow Chauffeur Drive Limited maintains a strict non-smoking policy in all vehicles.
- The client(s) is responsible for any damage they cause to the interior and/or exterior of a vehicle(s) on hire to them and will be charged accordingly for any repair or valet required in order to re-instate a vehicle(s) to working order.
- Rainbow Chauffeur Drive Limited may, when required, provide subcontracted vehicle(s) as requested.
- Rainbow Chauffeur Drive Limited reserve the right to change your vehicle(s) or chauffeur(s) at any time if necessary.
- Every effort will be made by Rainbow Chauffeur Drive Limited to ensure that the vehicle(s) or Sub-Contractors vehicle(s) arrive on time; however, Rainbow Chauffeur Drive Limited accepts no responsibility for delays, however caused.
- Rainbow Chauffeur Drive Limited chauffeurs will travel by the most appropriate route on the day, unless instructed otherwise by the client(s) at the time of booking.
- Rainbow Chauffeur Drive Limited vehicle(s) and Sub-Contractors vehicle(s) are fully insured for clients and third-party claims. All client(s) properties and valuables are carried entirely at the client(s) own risk and Rainbow Chauffeur Drive Limited shall not be held responsible/liable for any loss/damage to such property.
- We will endeavour to return lost or left property in any Rainbow Chauffeur Drive Limited or Sub-Contractors vehicle(s) back to the client(s) at a mutually agreed time, any special journey to return such property may result in an additional charge to the client(s).
- Rainbow Chauffeur Drive Limited and its chauffeur(s) have the right to refuse to carry any client(s) who are thought to be under the influence of alcohol or drugs and whose behaviour poses a threat either to the chauffeur(s), the vehicle(s) or any other passenger(s).
- By supplying your email address or telephone number you permit Rainbow Chauffeur Drive Limited to contact you via email or telephone. In return we promise never to supply your email address or telephone number to any third party unless requested to do so by the client(s).
- Nothing contained in these terms and conditions affect the client(s) statutory rights.
Fraud
- Payments must be authorized by the cardholder named in the booking. We withhold the right to cancel your booking without prior notice if we reasonably suspect that you or the cardholder are associated with any kind of fraudulent activity. Such suspicion may be based on the following activities:
- You cannot provide, when questioned, information about the itinerary such as full pick up and destination addresses, full passenger name and contact number, or any other mandatory requirements by the company.
- You cannot provide when questioned, contact information for the cardholder so that we may carry out security checks.
- The cardholder did not authorize the payment and claims that the booking is fraudulent.
- There has been previous fraudulent activity/chargebacks by you or the cardholder.
- Information given while booking is erroneous/ inadequate/ inconsistent/ linked to fraudulent behaviour.
- There have been multiple payment attempts with inconsistent data entered.
Child Seats
- Requests for child seats must be made at the time of booking. We will always aim to satisfy such requests, but failure to do so will not constitute a breach of contract.
- If you wish to use our/your own child seat, you will be responsible for installing it safely and removing it at your destination. Care must also be taken to not damage the vehicle interior with your child’s seat. Otherwise, you will be charged to compensate for this.
Conveyance of Animals
- No animals may be carried on any vehicle without prior written agreement from the company. Please note that additional costs will be incurred if travelling with animals. Cost to be confirmed with the company before placing a booking.
Responsibilities
- Rainbow Chauffeur Drive accepts no responsibility for any loss or damage to any luggage or property carried in or on the car unless the loss or damage is a result of negligence by Rainbow Chauffeur Drive. In the event of the property being left in a vehicle, we will gladly organize the return of such items, if the client covers the postage cost.
Damage to Vehicles
- If the interior or exterior of the vehicle is soiled or damaged by the customer, a valeting, repair charge or any loss of earnings for that chauffeur or vehicle will apply to the credit or debit card provided at the time of booking. Refusing to pay for the damage caused, legal action will be taken.
Insurance
- All Rainbow Prestige Chauffeur vehicles carry fully comprehensive chauffeur insurance with passenger liability cover
Zero Tolerance Policy
- We have a zero-tolerance policy against harassment, discrimination, and rudeness either verbally or in writing against our employees and contractors. In such an event, we reserve full rights to withdraw our goods and services to consumers effective immediately. Full money paid for goods and services won’t be refundable.
- Any passenger who is thought to be under the influence of alcohol or drugs and whose behaviour poses a threat to the driver, the vehicle or other passengers will be refused travel.
Complaints
- We trust have a that you will have no cause to complain, but in the event of this being necessary, it must be done, in writing, as soon as possible and, in all events, within 14 days of the end of the hire
